These Terms and Conditions govern your use of the Betterlex website at https://betterlex-recruitment.com  (« Betterlex Site ») and mobile app, and your relationship with Betterlex (« Betterlex », « we » or « us »). Please read them carefully as they may affect your rights and obligations under the law. If you do not agree to these Terms and Conditions, please do not use the Betterlex Site. 1. Employers

If you are seeking to instruct Betterlex for the provision of recruitment services, our standard terms and conditions shall apply (copy available upon request). Betterlex makes no representation or warranty in respect of any of the following:

  • the existence or availability of any appointment advertised on the Betterlex Site; or 
  • the final terms and duration of any appointment obtained through the Betterlex Site.

2. Candidates

When you register as a candidate, or when Betterlex contacts you via telephone or email for a temporary or permanent position, you accept becoming part of an Agreement with Betterlex which comprises participating in recruitment processes and receiving any alert of vacancies that may fit your profile. The rights and obligations entailed by the acceptance of said Agreement are set out in these Terms and Conditions, which you will accept at the time of registration, or when you receive it via email once you confirm your interest in becoming part of our Database. The recruitment services for candidates are free of charge. You can stop being part of this relationship at any time, by contacting us using the contact details described below.

3. Use of the Betterlex Site

We operate the Betterlex Site to assist you in understanding Betterlex’s services and in communicating with us. 

The Betterlex Site is provided for your personal use subject to these Terms and Conditions. If you are unable to access all/part of our site or upload your CV, then please contact us at support@betterlex-recruitment.com and we will provide further support.

4. Amendments

We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the Betterlex. We will notify you of any changes, including (i) the scope of changes, (ii) the objection period, (iii) the fact that non-objection shall be regarded as acceptance and (iv) the consequences of objection. The changes will apply after we have given notice.

4. Your use of the Betterlex Site

You may not use the Betterlex Site for any of the following purposes:

  • disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws; 
  • transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any applicable laws, regulations or code of practice; 
  • interfering with any other person’s use or enjoyment of the Betterlex Site; or 
  • making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
You will be responsible for our losses and costs resulting directly from your breach of this clause.

5. Registration

You can create an account by registering on the Betterlex Site. This gives you various options such as the possibility of receiving an unlimited number of job alerts, the ability to upload up to three CVs, etc. If you register, you must ensure that the details provided by you on registration or at any time are correct and complete. Please inform us without delay of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively. 

By registering to use the Betterlex Site, you will be asked to create a password. In order to prevent fraud, please keep this password confidential and do not disclose it or share it with anyone. If you know or suspect that someone else knows your password, please notify us immediately by contacting us at support@betterlex-recruitment.com If Betterlex has reason to believe that there is likely to be a breach of security or misuse of the Betterlex, we may require you to change your password or we may suspend your account.

6. Right to suspend or cancel your registration

We may suspend or cancel your registration immediately if you breach any of your obligations under these Terms and Conditions.

 You may delete your registration at any time from your own account on the Betterlex Site. In addition, you may unsubscribe from receiving marketing communications through the « unsubscribe » link contained in the last marketing communication received from us, by at support@betterlex-recruitment.com 

The suspension or cancellation of your registration and your right to use the Betterlex Site shall not affect either party’s statutory rights or liabilities.

7. Disclaimer

Whilst Betterlex uses reasonable care in compiling and presenting the content found on the Betterlex Site, it is provided purely for information and you should seek further guidance and make independent enquiries before relying upon it. If Betterlex is informed of any inaccuracies in the material on the Betterlex Site, we will attempt to correct the inaccuracies as soon as we reasonably can. 

If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer to the extent that they are a foreseeable consequence to both of us, and our liability shall not in any event include business losses such as lost data, lost profits or business interruption, to the extent permitted by applicable law. 

These Terms and Conditions shall not limit or affect our liability in case of gross negligence or wilful misconduct, or if something we do negligently causes death or personal injury.

8. Availability of the Betterlex Site

We cannot guarantee that the service will be fault-free. If a fault occurs in the service, please send an email at support@betterlex-recruitment.com and we will attempt to correct the fault as soon as we reasonably can. If Betterlex is informed of any inaccuracies in the material on the Betterlex Site, we will attempt to correct the inaccuracies as soon as we reasonably can. 

Your access to the Betterlex Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

9. Intellectual Property

All information incorporated within the Betterlex Site is owned or licensed by Betterlex. You may retrieve and display the content of the Betterlex Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Betterlex without written permission from Betterlex.

10. Equal Opportunities & Diversity

We may also release information relating to you to regulatory or law enforcement authorities, if required to do so. We may use the information we have collected about you on an anonymized basis for the purposes of monitoring in relation to our equal opportunities policy. We also reserve the right to disclose the information we have collected about you to our professional advisers and to other persons to the extent that Betterlex contracts out any aspect of the operation of its recruitment agency services. These third parties will be acting under similar undertakings of confidentiality as Betterlex.

11. Applicable Law

These terms and conditions will be subject to the laws of Luxembourg. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement, and you want to take court proceedings, you must do so within Luxembourg.

12. Miscellaneous

You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected. 

If you breach these Terms and Conditions and Betterlex chooses to ignore this, Betterlex will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. 

Betterlex shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
